The Procedure for an Undefended or Uncontested Divorce
Where the two parties have indicated that they are not going to defend the divorce, and the court is satisfied with the documentation provided, the court will then inform both spouses of the date of the pronouncement of the Decree Nisi. This is the first decree and does not dissolve the marriage.
The Decree Nisi is pronounced in court by a judge. It is not necessary to attend court as a copy of the decree will be sent to both parties.
After six weeks, application for a Decree Absolute which dissolves the marriage can be made.
The court will then issue the Decree Absolute which again will be sent to both spouses.
What is Included in the Fixed Fee Divorce Service?
An initial face to face consultation at which some initial advice can be given about other matters arising out of the separation, such as arrangements for any children involved and financial settlement.
All the steps, from initial instructions through to Decree Absolute at the end of the divorce process, are included in the fixed fee service. This can involve face to face meetings with a qualified divorce lawyer, the handling of all court correspondence and queries, and regular updates to keep you fully informed at each stage.
How Much Will I Pay?
We offer a fixed price for the work that we carry out. It will be more cost effective for you than if you were to be charged by the hour, but it will not be at the expense of the quality of the service we provide you.
Our fees for the divorce are £300 plus vat. In addition, there is a court fee payable of £550. This is payable whether you instruct solicitors or not. In certain circumstances it is possible to ask the court to waive the fee.
If there are financial or child matters to be dealt with this is something we can certainly help you with, but it would involve separate fee arrangements.
